Terms and Conditions of the PPS Participation Title

Please read carefully the General Terms and Conditions of the Proof of Entry "Pass Prévention Santé" before subscribing to a "Pass Prévention Santé".

Definitions

GTC: Refers to this document, which constitutes the General Terms and Conditions of the Proof of Entry "Pass Prévention Santé".

FFA: Refers to the French Athletics Federation.

Sporting licence: Means any sporting licence issued by the FFA (within the meaning of Article 2.2 of the FFA General Regulations) or any other sporting licence issued by another federation and accepted by the FFA in order to take part in a sporting event under its regulations.

Sporting event: Means any competitive or non-competitive event - with the exception of those reserved for FFA licence-holders - taking place on French territory in a discipline for which the FFA has been delegated public service authority and whose organisation is, in particular, subject to declaration (for information) or to authorisation by the FFA in accordance with article L331-5 and/or article R331-6 of the Sports Code, including, without limitation, competitions at all distances in cross-country, road races, mountain races and off-road races, obstacle races, trail running, ultra trail and Nordic walking.

PPS Pathway: Means the PPS Pathway, a self-assessment, preventive and informational tool on the health risks associated with practising athletics. Its content is defined by the FFA, which derives this authority from the law.

PPS Proof of Entry: Means the proof of entry, within the meaning of the Sports Code and as referred to in article 2.4 of the FFA General Regulations, called "Pass Prévention Santé", issued by the FFA after (i) completion of a PPS Pathway and (ii) payment of the amount set by the FFA on the Website, allowing participation in a sporting event.

Website: Means the website published by the FFA, at the address https://pps.athle.fr

Subscriber: Means any natural person who subscribes to a PPS Proof of Entry on their own behalf via the Website, and becomes the holder of said Proof of Entry after the subscription has been validated on the Website.

Article 1 – Purpose of the General Terms and Conditions

The FFA, in its capacity as the federation entrusted with a public service mission within the meaning of Article L.131-14 of the French Sports Code, is responsible for setting the access conditions to sporting events covered by its delegation.

These General Terms and Conditions of the PPS Proof of Entry are intended to define the conditions under which the FFA, via its website https://pps.athle.fr/, issues the PPS Proof of Entry, as well as the conditions for its use by the Subscriber.

If you have subscribed to a PPS Proof of Entry on the Website, these GTC apply to you and constitute the contract between you and the FFA.

These General Terms and Conditions apply only to PPS Proofs of Entry subscribed via the Website.

These GTC therefore do not apply to any goods or services, other than this PPS Proof of Entry, acquired from the FFA, nor to any goods or services acquired from a third party, whether or not that third party is mandated by the FFA, and whether or not such goods or services are ancillary or related to this PPS Proof of Entry.

The FFA may revise and update the GTC at any time. Any amendment will apply immediately after being notified by any means, including by publishing a revised version of the GTC on the Website.

Article 2 – Authority issuing the PPS Proof of Entry

The PPS Proof of Entry is issued by the French Athletics Federation (FFA), in its capacity as the federation entrusted with a public service mission within the meaning of Article L.131-14 of the French Sports Code, an association registered in accordance with the law of 1 July 1901 Registered office: 33 avenue Pierre de Coubertin, 75640 PARIS Cedex 13, SIRET number 78444873000027

Article 3 - Legal basis for the PPS Proof of Entry

The PPS Proof of Entry is established pursuant to the French Sports Code (Appendix I-5 to Articles R. 131-1 and R. 131-11 of the French Sports Code) and the FFA General Regulations (Article 2.4 – Proof of Entry).

Article 4 – Description of the PPS Proof of Entry

4.1. Legal nature of the PPS Proof of Entry

The PPS Proof of Entry is a proof of entry within the meaning of the French Sports Code and article 2.4 of the FFA General Regulations, enabling adults (on the day of the sporting event) who do not hold a sporting licence to be eligible to take part in sporting events, without prejudice to the event access conditions as defined by their organiser.

Subscribing to a PPS Proof of Entry has the sole purpose of conferring this eligibility and does not constitute registration, reservation or an automatic right of access to any sporting event.

Registration for a sporting event is a separate process, subject to the conditions, procedures and capacity limits set by each organiser, and must be completed separately.

Actual participation in a sporting event is conditional on both holding a valid PPS Proof of Entry and being duly registered for that event.

4.2. Form of the PPS Proof of Entry

The PPS Proof of Entry takes the form of a digital card containing a unique number and a unique QR code, assigned to each holder of the PPS Proof of Entry.

The holder of a sporting licence cannot hold a PPS Proof of Entry.

4.3. Legal link created by the PPS Proof of Entry between the Subscriber and the FFA

This PPS Proof of Entry confers no rights other than those expressly set out in these GTC and in the applicable FFA Regulations.

Accordingly, the PPS Proof of Entry must not be considered a sporting licence within the meaning of Article 2.2 of the FFA General Regulations, in particular as it does not enable the Subscriber to take part in the operation and democratic life of the FFA.

By subscribing to a PPS Proof of Entry, the Subscriber declares that they understand and accept that the PPS scheme falls within the regulatory framework established by the FFA. Accordingly, the Subscriber declares their acceptance of all of its provisions.

The Subscriber, as the holder of a PPS Proof of Entry issued by the FFA, may be granted access by the FFA to content (in any form) exclusive to PPS Proof of Entry holders and/or sporting licence holders and/or persons belonging to the FFA ecosystem (for example: content on preventing health risks for runners, access to a statistics/results platform, etc.).

4.4. Mandatory requirement to participate in sporting events

The PPS Proof of Entry is mandatory for anyone who does not hold a sporting licence and wishes to participate in a sporting event, including foreign participants, unless otherwise provided by regulation.

Warning: The PPS Proof of Entry does not constitute either a registration or a guarantee of effective access to a sporting event, which remains subject to the specific conditions set by its organiser.

The cancellation, postponement or modification of a sporting event, for whatever reason, shall not affect the PPS Proof of Entry, which cannot be refunded nor have its validity period extended.

4.5. Territorial scope

The PPS Proof of Entry is valid exclusively for sporting events held on French territory.

4.6. Nominative nature of the PPS Proof of Entry

The PPS Proof of Entry is strictly personal and nominative.

It may under no circumstances be assigned, sold, lent or transferred to a third party, whether free of charge or for consideration.

The verification of the nominative nature and validity of the PPS Proof of Entry is carried out by the sporting event organisers and, in particular when the organisers are labelled by the FFA, by means of dedicated software tools and application programming interfaces (API) shared between the FFA and those organisers.

Any fraudulent use, false declaration or attempt to circumvent the system may result in the termination of the PPS Proof of Entry without refund, as well as any other measures provided for in the FFA regulations.

4.7. Suspension or withdrawal of the PPS Proof of Entry

The FFA reserves the right to suspend or terminate the PPS Proof of Entry with immediate effect, without compensation or refund, under the terms and limits of its federal regulations, in the event of:

  • non-compliance with the GTC or with federation regulations,
  • a false statement,
  • a breach of safety or sporting ethics rules,
  • or a reasoned decision taken in the interest of sporting order.

Article 5 – Validity period and use of the PPS Proof of Entry

The PPS Proof of Entry is valid for a period of twelve (12) months from the date of issue.

During this period, it allows the Subscriber to demonstrate compliance with the federation's regulatory obligations required prior to participating in a sporting event, in particular those relating to medical fitness, within the limits of the requirements set out by the applicable sporting regulations, for an unlimited number of sporting events, without prejudice to compliance with the sporting regulations and the registration conditions specific to each sporting event, where applicable, set by its organiser.

Article 6 – Amount due for the issuance of a PPS Proof of Entry

The price of the PPS Proof of Entry is set at five euros (five euros). The price is firm and final at the time of subscription.

Article 7 – Subscription procedures

7.1 Online subscription

Subscription is made exclusively on the Website: https://pps.athle.fr/ Subscriptions sent by e-mail or by post will not be accepted by the FFA.

To be able to subscribe to their PPS Proof of Entry on the Website, (i) an account must be created on the Website and, accordingly, the Subscriber accepts the Website's Terms of Use and the PPS Privacy Policy, and (ii) the PPS Pathway must have been completed by the Subscriber prior to making the online payment (under the conditions set out in article 7.3).

The FFA will acknowledge receipt of the subscription by sending a confirmation e-mail to the Subscriber, which will contain the summary (including the downloadable PPS Proof of Entry). The payment receipt will be sent by the payment service provider.

The Subscriber guarantees the accuracy, completeness and currency of the information provided when subscribing, which are necessary for the title to be issued in the Subscriber's name.

7.2 Acceptance of the Terms and Conditions

Any subscription to a PPS Proof of Entry implies full and unconditional acceptance of these Terms and Conditions, evidenced by an electronic confirmation (a checkbox confirming acceptance of these Terms and Conditions) before payment.

7.3. Payment

Only online card payments (by entering card details or via Apple Pay and Google Pay) on the Website are permitted.

Online payments are processed via a secure payment platform.

The details of your payment card provided when subscribing are never transmitted in clear text over the internet: they are encrypted using an SSL security protocol.

Article 8 – Issuance and performance

The PPS Proof of Entry is issued immediately after payment confirmation and is usable as soon as it is received by its Subscriber.

The Subscriber can access their PPS Proof of Entry in its dematerialised version, called "Pass" or "Pass Prévention Santé" or "PPS" on the Website:

  • From their personal area on the Website, in the "history" tab. The Subscriber will then be able to download it to the electronic device of their choice or add it to their "Wallet" if they have an iOS or Google device.
  • From the confirmation email that was sent to them.

Article 9 - Liability - Force Majeure

The FFA cannot be held liable where the non-performance of its obligations is attributable either to an unforeseeable and insurmountable act of a third party to the contract or to a case of force majeure as defined by Article 1218 of the French Civil Code and by French case law.

Similarly, the FFA cannot be held liable for any inconveniences or damage inherent to the use of the Internet, in particular a service interruption, an external intrusion or the presence of computer viruses.

Article 10 – Insurance and warranty – IMPORTANT INFORMATION

10.1 Civil Liability Insurance

In accordance with applicable law, civil liability insurance covers, under the terms and limits set out in the information notice, the Subscriber for damage they may cause to third parties in the context of their participation in the relevant sporting events.

The coverage, limits, exclusions and procedures for implementing this insurance are detailed in the insurance information notice.

The Subscriber acknowledges having been informed of the existence and content of this notice prior to subscribing to the PPS Proof of Entry, evidenced by an electronic validation (a checkbox confirming this information), and declares that they unreservedly understand the scope of this insurance cover.

Please note that this insurance does not cover bodily injury sustained by the Subscriber themselves.

The Subscriber is advised to ensure that they personally have suitable individual cover.

10.2 Individual Accident Insurance

Warning: The PPS Proof of Entry does not include individual accident insurance.

This insurance is nevertheless strongly recommended.

This insurance guarantees the payment of a capital sum in the event of bodily injury (death or permanent disability) resulting from an accident occurring during participation in a sporting event.

It is therefore the Subscriber's responsibility to check with their usual insurer that they have appropriate cover and, if necessary, to take out any additional cover they consider necessary.

Article 11 – Health and prevention

The purchase of the PPS Proof of Entry is part of a prevention and awareness programme aimed at promoting the health and safety of participants in sporting events.

When subscribing to this PPS Proof of Entry, the Subscriber is informed of recommendations concerning sporting activity, their health status and the risks inherent in participating in sporting events.

Article 12 – Accuracy of information and liability

The Subscriber undertakes to provide accurate, complete and, where applicable, up-to-date information when subscribing to the PPS Proof of Entry and for the entire duration of its validity.

The FFA cannot be held liable for negative consequences resulting from inaccurate, incomplete or not up-to-date information provided by the Subscriber, notably concerning identity, health status or failure to comply with the access conditions for a sporting event.

Article 13 – Termination before participation in a sporting event

As long as the Subscriber has not participated in any sporting event and within fourteen (14) days following their subscription to the PPS Proof of Entry, the FFA grants them a right to cancel enabling them to terminate the said Proof of Entry and obtain a refund. This right may be exercised by sending a request to the following address: contact.pps@athle.fr

Article 14 – Personal data

The personal data collected in connection with the issuance and use of the PPS Proof of Entry are processed in accordance with applicable law. The processing methods, purposes, retention periods and the rights of the data subjects are detailed in the "Privacy Policy – Pass Prévention Santé", issued by the FFA.

Article 15 – Applicable law and competent jurisdiction

These General Terms and Conditions are subject to French law.

In the absence of an amicable settlement, any dispute relating to their interpretation or performance shall be subject to the jurisdiction of the competent courts.
